  7. Money-laundering prevention. When lawyers practice certain activities on behalf of their clients, they are subject to the preventive part of the money laundering legislation (Belgian Act of 11 January 1993 on the prevention of the use of the financial system for money laundering and the financing of terrorism). This legislation aims to combat money laundering and the financing of terrorism and for this purpose imposes a number of binding obligations on lawyers, non-compliance of which can lead to disciplinary sanctions and administrative fines. First of all, we are obliged to identify our clients and to request and retain a number of documents that support that identity. During the entire duration of the client relationship, we are also subject to a duty of vigilance that may lead us to request additional information. We have this information and vigilance obligation with regard to both our clients themselves (natural persons and legal entities) and their proxy holders (such as the directors of companies). When we, in carrying out the activities covered by the money-laundering legislation, identify facts that we know or suspect to be related to money laundering or terrorism financing, we must report this immediately to the Chairman of our Bar Association, except when our work consist of determining the legal position of our client or the defence or representation of our client in (connection with) legal proceedings. It is the Chairman who will decide whether or not to pass on the information received to the Belgian Financial Information Processing Unit. These obligations do not affect the professional secrecy that continues to characterize the relationship between the client and his lawyer. If you have any questions in this respect, please do not hesitate to contact us.
  8. Questions and complaints. We strive to provide our clients with the best possible service. If you are not satisfied with our service or have questions about it, please do not hesitate to contact us via the contact details mentioned above.
