ACTA’s referral to the ECJ: the European Commission’s response to the concerns of EU citizens on digital enforcement of copyright

On April, 4th, the European Commission announced its decision to refer the ACTA to the European Court of Justice. According to the Commission, this will allow this Court to proceed to a detailed examination of whether the online copyright enforcement measures foreseen under ACTA are compatible with several fundamental rights such as the freedom of expression and information, the right to data protection and the right to property (including that of intellectual property).

Intellectual property (copyright, neighbouring rights, trademarks, designs, patents, etc.) is becoming increasingly important. Many of our clients' business mainly consists of developing and commercializing assets that are protected by intellectual property rights.

Today the worldwide intellectual property community celebrates World Intellectual Property Day. According to the World Intellectual Property Organization (WIPO) this is a great opportunity to generate public and media interest in issues relating to intellectual property.

As intellectual property law is one the core specialties of time.lex, we gladly join this celebration.
