Meerkat en Periscope : juridisch in orde of illegaal?

Meerkat en Periscope zijn twee apps voor livestreaming van video’s via het sociale mediaplatform Twitter. De online livestreaming diensten van Meerkat en Periscope hebben enkele juridische implicaties waar veel gebruikers zich meestal niet bewust van zijn. Zo moet je bij het uploaden van live videobeelden die anderen dan live kunnen streamen, rekening houden met auteursrechten, naburige rechten, algemene voorwaarden en privacyrechten. Bovendien kan je verantwoordelijk worden gesteld voor het uploaden van illegaal verkregen beelden.

He graduated from the University of Leuven (2001) and was a visiting student at the Law School of Northwestern University (Chicago, US) (2000). He was admitted to the Brussels Bar in 2001. Johanne is specialised in intellectual property law, both in contentious and transactional matters. She also has an excellent reputation in media law, advising broadcasting companies, TV distributors, TV production houses and other market players on media legislation compliance and assisting them in negotiating contracts and protecting their rights.

She also has extensive experience in unfair competition and advertisement law. She is a co-author of one of the reference publications on these topics: “Les pratiques loyales”, published by Larcier in 2012 (in French).

Johanne obtained her law degree from the University of Liège in 2001 and a Master of Law in Intellectual Property and New Technologies from the University of Liège and the University of Leicester in 2002. Nieuwe Europese Gegevensbescherming Begeleiding inzake het Internet of Things

De Werkgroep Artikel 29,  het belangrijkste EU-orgaan inzake gegevensbescherming, publiceerde onlangs een Advies over de toepassing van de Europese regelgeving inzake gegevensbescherming op het Internet of Things. Het toont een interessante evolutie in de Adviezen van de Werkgroep aangezien de prioriteiten van de verwachte Algemene Verordening Gegevensbescherming er nu voorzichtig doorschemeren.

Verordening Elektronische Identificatie en Vertrouwensdiensten (eIDAS) Gepubliceerd

De voorgestelde Europese Verordening inzake elektronische transacties in de interne markt is nu aangenomen, waarbij het merendeel van haar bepalingen vanaf 1 juli 2016 van kracht zal gaan. De Verordening zal niet alleen de bestaande Richtlijn inzake elektronische handtekeningen intrekken, maar zal automatisch ook iedere strijdige nationale wet in Europa vervangen.
