On April, 4th, the European Commission announced its decision to refer the ACTA to the European Court of Justice. According to the Commission, this will allow this Court to proceed to a detailed examination of whether the online copyright enforcement measures foreseen under ACTA are compatible with several fundamental rights such as the freedom of expression and information, the right to data protection and the right to property (including that of intellectual property).
